Interpreters in legal proceedings
- Criminal Procedure Code section 13 requires proceedings in Thai and an interpreter for a suspect, defendant, injured person or witness who does not understand Thai, at both investigation and trial stages.
- The Supreme Court has held that use of an interpreter at each hearing is within the court's discretion on the facts, so request one from the first hearing.
- Interpreters must take an oath or affirmation before interpreting. For rare languages, propose an interpreter to the court in advance.
- Foreign-language documents used as evidence need an attached Thai translation, which is document translation, separate from interpreting.
Frequently asked questions
Can a relative or friend interpret?
Sometimes, at some stages, but it is not advisable in legal or medical matters: they have an interest and may not interpret fully, which risks the statement being challenged later.
How far ahead should I book?
It depends on language and place. Major languages can often be arranged quickly; rarer languages or work outside Bangkok need several days' notice. Urgent work depends on availability.
Can interpreting be done by video?
Yes for ordinary meetings. Court hearings or official procedures need permission from the court or authority first.
